Visit www.sharp-smoker.com between March 1, 2010 and March 31, 2010, click on the Sweepstakes link, and complete and submit the online registration. You may enter the sweepstakes as many times as you desire to increase your chances of winning. Incomplete or illegible entries are not eligible. Entering invalid personal information will result in sweepstakes disqualification. Online entries must be submitted and received by 11:59 PM ET March 31, 2010.
2. Drawing: Potential winner will be selected via random drawing, on or about April 5, 2010 in Mooresville, NC, from among all eligible entries received. Drawing will be conducted by a Sharp Smoker LLC employee. The winner will be contacted by email or phone and must then provide a copy of their valid drivers license which matches the entry information for the sweepstakes. The winner must return this document within 14 days of being contacted as the winner, or prize will be forfeited. If potential winner is a minor in his/her jurisdiction of residency under the age of 18, the prize will be forfeited and another potential winner will be selected.
3. Prizes: One Prize consisiting of: One electronic cigarette starter kit, 1 extra atomizer, 1 carrying case, 1 car charger adaptor, 3 boxes of 5 nicotine cartridges, and 5 bottles of e-liquid. No substitution, cash redemption, cash alternative, or assignment or transfer of the prizes is permitted, in whole or in part. If the winner declines the Prize, fails to claim the Prize, is unavailable for Prize fulfillment, or fails to abide by these Official Rules, Sharp Smoker LLC may select an alternate winner from all remaining eligible entries. In no event will more than stated number of prizes be awarded. By accepting a prize, winner agrees to the release of his or her name and/or likeness for potential publicity purposes, where permitted by law. Odds of winning are dependent upon the number of eligible entries received.
4. Eligibility: Sweepstakes is open only to legal residents of the 50 United States and Washington DC (including Puerto Rico) who are at least eighteen (18) years of age and able to legally purchase nicotine products in their state of residence at the time of entry. By entering the Sweepstakes, you agree to be bound by Sharp Smoker LLC's privacy policy located at privacy policy. Sweepstakes is void where prohibited, and is subject to all applicable Federal, State, and local laws and regulations. By entering, participants agree to be bound by these official rules.
5. Limitation of Liability: Sharp Smoker LLC and its promotion partners are not responsible for printing or typographical errors in any sweepstakes-related materials; or for any individual's inability to enter the sweepstakes, including but not limited to unavailable network, server, or other connections; failed software or hardware transmissions; other errors of any kind, whether human, mechanical, or electronic, including lost, late, incomplete, damaged, or misdirected entries; or for any damage to any computer related to or resulting from participation. Multiple entries beyond what is specified in section 1, and those that are generated by script, macro, or other automated entry devices are not valid, and will be disqualified. Entries that are tampered-with, forged, illegible, mutilated, altered, mechanically duplicated, or obtained through unauthorized distribution channels are not valid and will be disqualified. Sponsor reserves the right to cancel or modify the promotion should any of the foregoing occurrences corrupt or impair the administration, security, fairness, or proper play of the promotion, as determined by Sharp Smoker in its sole discretion. If the promotion is cancelled for any reason listed above, Prize winner will be determined via random drawing from all eligible entries received up to the time of promotion cancellation. Entrants agree that Sharp Smoker and their respective employees or officers shall not be liable for injury, losses, damages, or costs of any kind resulting from participation in this promotion or acceptance of or use or misuse of a prize or parts thereof.
6. Dispute Resolution: THIS PROMOTION IS GOVERNED BY THE LAWS OF THE UNITED STATES AND THE STATE OF NORTH CAROLINA, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this promotion, participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this promotion, shall be resolved individually, without resort to any form of class action, exclusively before a court located in North Carolina having jurisdiction. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys' fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this promotion), and participant further waives all rights to have damages multiplied or increased.
